  1. Written notice of your injury must be submitted to your Employer in writing within four working days or as soon thereafter as possible.

    A Workers Claim for Compensation needs to be filed with the Division of Workers Compensation within 2 years.

  2. The Insurance Company or its employer has 20 days to state its ‘position’ in writing. This is either done by an Admission of Liability or a Notice of Contest. If the carrier admits liability through an admission, you would be entitled to some or all of the following:

    1. Medical bills paid

      Reimbursement for mileage to and from doctors’ appointments

      Payment for lost wages based on 2/3 of your gross Average Weekly Wage up to the maximum by law

      Pay for permanent impairment

    2. Disfigurement benefits for visible disfigurement (scarring, burns, cuts, amputations)

If the carrier disagrees with your claim you should receive a Notice of Contest. You will then have 45 days from the certificate of mailing to file for an Expedited Hearing to have your case heard in front of an Administrative Law Judge.

  1. You have a right to seek medical treatment with your employer’s designated physician or the physician of your choice if your employer fails to designate a physician.
